This website is operated by ERGOWORKS LIFESTYLE SDN. BHD. (“Ergoworks”) and the terms “we”, “us” and “our” used throughout the site refer to ERGOWORKS LIFESTYLE SDN. BHD. ERGOWORKS LIFESTYLE SDN. BHD. offers this website, including all information, tools and services available from this site to you, the user, conditional upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

 

1. ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence, or that you are the age of majority in your country of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any malicious software, including but not limited to viruses or malware, or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

 

2. CHANGES TO TERMS OF SERVICE

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

 

3. GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

 

4. GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Malaysia.

 

5. PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate against any person; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

 

6. PRODUCTS AND RETURN POLICY

Certain products may be available exclusively online through the website. These products may have limited quantities and our return policy allows you to return products within fifteen calendar days of the date of delivery.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

 

Return Policy

 

Eligibility for Returns:

  • All in-stock items are eligible for returns within 7 days of delivery, except for customised items, indent items, clearance items, sales items, and after sales parts.
  • Items must be returned in their original packaging, with tags intact, and must be in like-new condition together with the receipt or proof of purchase to be eligible for return.
  • Due to hygiene concerns, backrests, insoles, sport-wear sleeves, seat cushions, pillows, and mattresses are not eligible for return.
  • If any defects are found within 7 days of delivery, please refer to our defect reporting process.

 

Return Conditions:

  • Claims regarding discrepancies in the quantity of products delivered must be reported within 2 days from the date of delivery. Failure to do so will result in the buyer being liable for the full price of the order as delivered.
  • Returns based solely on cosmetic defects that do not affect the functionality of the product will not be accepted.

 

Return Process:

  • Contact our customer service team at biz@ergoworks.com.my. Please provide your order invoice number and specify the reason for the return.
  • Ensure the item is in its original packaging, unused, and in the same condition as when you received it.
  • Return the item using a traceable shipping method. The cost of return shipping is the responsibility of the customer.
  • Once received, the item will be inspected to verify its condition and compliance with our return conditions and eligibility.

 

Exchanges:

  • You may exchange any returned item for another of equivalent or greater value.
  • Exchanging for a product of lower value will incur a 10% restocking fee based on the price of the originally delivered product.
  • In cases where the total payment after returns is negative, no refund will be issued.
  • All exchanges and returns will be processed on a case by case basis.

 

 

Refund Policy

 

Processing Refunds:

  • Once your return is received and inspected, we will notify you of the approval or rejection of your refund.
  • Approved refunds will be processed within 14 business days using the original payment method.

 

Exclusions:

  1. Shipping fees
  2. Gift Cards
  3. Vouchers
  4. Redemption from external promotions (e.g, giveaways, credit card gifts)
  5. Purchases made through external sites or third-party vendors are not eligible for refunds under this policy.

 

Fees and Deductions:

  • An open box fee up to 10% is chargeable for all furniture items (e.g, desks, chairs, sit-stand desk converters, recliners etc).
  • If damages or missing parts are identified upon inspection, fees up to 30% of the product's purchase value may be deducted from your refund.
  • Any applicable fees will be deducted from the refund amount and detailed in the refund notification email sent by our relevant operations team.
  • A cancellation fee of 10% is applicable if the order is cancelled before shipment.

 

 

Reporting defects

 

Ergoworks is dedicated to delivering high quality customer service and effective solutions for all our customers.

  • To report a defective item, please send a request to our customer service team via email at biz@ergoworks.com.my or submit your case on our after sales support page.
  • Please prepare the order invoice number, photos of the defect(s), and a brief description of the issue.
  • We will assess your claim and respond with a proposed solution, which may include repair, replacement, or refund. This process may take up to 7 business days for in-stock items and up to 60 business days for indent or customised items, depending on stock availability.

 

 

Warranty Policy


The following policy applies for items sold and shipped by ERGOWORKS and only to products purchased (“ERGOWORKS Products” or “Products") and does not cover products manufactured by brands other than ERGOWORKS.

The product warranty is valid exclusively for the original purchaser of the products only and is non-transferable.

Valid warranty services are only offered for products purchased through authorised channels. Our authorised channels are the official website (https://www.ergoworks.com.my) and any store(s) registered in the name of a ERGOWORKS entity online. Unfortunately, we cannot verify the authenticity or original condition of products purchased through unauthorised channels. As a result, we do not provide warranty services for products acquired from such sources.


What is covered

  • Defects in manufacturing of materials used for the products at the time of delivery.
  • Any cosmetic defects must be reported within 7 calendar days from the date of delivery.

Coverage for such defects is at the discretion of Ergoworks.

  • Defects in the functionality of the products, including but not limited to hydraulics, armrest, castors and lifting mechanism.
  • Electric Standing Desk: Defects in the functionality of the electronic parts such as the control box, lifting mechanism, control panel and desk frame.
  • Pneumatic Standing Desk: Defects in the functionality of mechanical parts and gas spring only (if any).
  • Ergonomic Chair: Defects in the functionality of mechanical parts and hydraulic gas lifting only or otherwise stated in the warranty coverage of each product item (excluding wear and tear).
  • Kids Ergonomic Study Table and Chair: Defects in the functionality of mechanical parts and hydraulic gas lift only or otherwise stated in the warranty coverage of each product item. (excluding wear and tear)
  • School Bag: Defects in the functionality of the bag structure (excluding wear and tear and lost parts) and the zippers within the warranty coverage period.



Terms of Warranty

Ergoworks reserves the right to determine eligibility for warranty claims and to decide whether a defective part should be repaired or replaced.

Depending on the severity of the issue, Ergoworks reserves the right to decide whether to send a technician onsite. Minor issues such as loose screws, removal of plastic labels or wrappers, and device resets may be handled by customers without onsite support.

If a replacement is required in accordance with this warranty and the defective materials or merchandise has been discontinued or unavailable, Ergoworks reserves the right to substitute a similar item of equal value. Otherwise, the same product or material will be provided for replacement.


Note

  • The warranty is effective from the date of delivery.
  • Once the warranty has expired, a service fee of RM300 covering transportation and labour will be required upfront to confirm on-site service appointments. Additional charges for replacement parts will be borne by the customer if required.
  • The warranty is valid only for the original purchaser and is non-transferable. Benefits conferred by this warranty cannot be assigned or transferred, and no rights under these terms and conditions will extend to persons who are not the original purchasers.
  • The warranty will be void if the product is used inappropriately, altered, or cleaned with incorrect methods.



Warranty Claim Process


Ergoworks is dedicated to delivering high quality customer service and effective solutions for all our customers.

  • To submit a warranty claim, please contact our customer service team via email at biz@ergoworks.com.my or submit a product service request on our after sales support page.
  • Please prepare the order invoice number, photos of the defect(s), and a brief description of the issue.
  • We will assess your claim and respond with a proposed solution, which may include repair, replacement, or refund. This process may take up to 7 business days for in-stock items and up to 60 business days for indent or customised items, depending on stock availability.


Note

Ergoworks reserves the right to refuse any warranty claims if it believes that the claim is fraudulent or made in bad faith.

Components replaced under this warranty may vary in colour and texture to the original due to batch and material availbility.



Limitations of liability

Ergoworks is responsible only for the actual and direct damages proven to have resulted from your purchase of the products.

Our liability to you shall not, under any circumstances, exceed the amount you paid for the products.

We do not exclude or limit our liability in any way where it would be unlawful to do so.


This includes liability for:

  1. Death or personal injury resulting from negligence
  2. Fraud or fraudulent misrepresentations
  3. Consumer protection that is mandated by statute and cannot be waived or limited by contract.

 

Delivery Policy


  •  All item except bulky items

For order amount of less than MYR 500, the delivery charge is MYR 25 (West).

For order amount of less than MYR 500, the delivery charge is MYR 50 (East).

For order amount of MYR 500 and above, delivery is Free Of Charge within West Malaysia (Sabah & Sarawak excluded)

  •  Bulky items 

Within Klang, all the bulky items - desk, chair, recliner, mattress would be delivered & installed Free Of Charge.

Outside of Klang, other state and East Malaysia, an additional delivery & installation cost would be quoted and charged.   .

The additional delivery charge is calculated based on delivery address distance, on single trip & per location.

  • Ergoworks will make (1) ONE attempt to deliver goods to the address indicated on the delivery order.
  • All subsequent delivery attempt(s) will incur a charge of RM300 per trip.
  • Customers are expected to inspect all goods upon delivery and report any missing or incorrect items on the same day. No claims or compensation will be entertained after the goods have been received.
  • Delivery dates and times are approximate. Delays will not be accepted as a reason for cancellation of any order.
  • Ergoworks may cancel orders without notice or compensation under certain circumstances that are beyond our control, including but not limited to the inability to obtain materials, labour and supplies, strikes, lock outs and other forms of industrial actions or disputes, fires, flood, drought, weather conditions, war, civil, disturbance, act of God, or any other disruptions. In such circumstances, the deposit paid will be refunded without interest.
  • All payments must be completed before delivery; Cash on Delivery is not accepted.
  • Disposal of old furniture is not included and must be managed by the customer. Ergoworks accepts no liability for any consequential loss or damage, however caused, during the delivery process.
  • Failure to accept goods after one month from the confirmed delivery date, the order will be deemed cancelled and Ergoworks reserves the right to dispose of the goods as deemed fit.



Delivery Terms and Conditions


By accepting delivery of goods from Ergoworks, the customer agrees to the following terms:


  • The customer recognises that despite Ergoworks' careful handling, unexpected incidents may occur during delivery that could damage their property.
  • The customer indemnifies Ergoworks, its staff, agents, and affiliates against any claims or costs due to damages incurred during delivery, such as scratches or dents.
  • This indemnity covers damages caused by Ergoworks' delivery team or third-party delivery services used by Ergoworks.
  • Ergoworks is not liable for any indirect damages from delivery, including loss of use, profits, or other economic losses.
  • This indemnity remains valid unless altered in writing by both Ergoworks and the customer.
  • The customer is responsible for providing clear and accurate delivery details, including any obstacles or special requirements for safe delivery.

 

7. ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

 

8. MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

 

9. ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse or cancel any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall Ergoworks Lifestyle Pte Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Ergoworks Lifestyle Pte Ltd and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

17. SEVERABILITY

If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

18. TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

 

19. ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
